1. About these terms
This website, addostore.com, is operated by Jade Quinton Maggs trading as Addo Outdoor (ABN 46 583 460 215), based in Brisbane, Queensland. In these terms, "we", "us" and "our" mean Addo Outdoor, and "you" means anyone using the website or buying from us.
By using this website or placing an order, you agree to these terms. If you do not agree, please do not use the website. These terms apply together with our Refund Policy, Shipping Policy and Privacy Policy, which are linked in the website footer. Our online store runs on Shopify.
2. Using this website
You must be at least 18 to place an order, unless a parent or guardian places it or gives permission. Please give accurate details when you order or create an account, and keep your login private.
You must not:
- use the website for anything unlawful
- copy, scrape or crawl the website, or use bots to buy or collect data
- send viruses or anything else harmful
- try to get around the website's security
- give false or misleading information
- harass or abuse other people
- infringe anyone else's rights
3. Products and website information
We take reasonable care to describe our products, sizes and prices accurately. Colours may look slightly different on your screen. If you find an error, please tell us. Nothing in this clause limits your rights under the Australian Consumer Law.
Some products are available in limited quantities. We may change or discontinue products at any time. This does not affect an order we have already accepted.
4. Prices and payment
All prices are in Australian dollars. The price you pay is the price shown at checkout when you place your order, including any shipping charge shown there.
Payments are processed by Shopify Payments and its payment partners. We do not see or store your full card number.
We may change prices at any time. A price change does not affect an order we have already accepted. If a price is wrong, clause 5 applies.
5. Orders and when a contract is formed
When you place an order, you are making an offer to buy. Our order confirmation email shows that we received your order. A contract is formed when we dispatch your order and send you a dispatch email.
Until then, we may decline or cancel an order, for example because:
- an item is out of stock
- a price or product description is wrong
- we reasonably suspect fraud
- we cannot deliver to your address
If we decline or cancel an order, or part of one, we will refund in full anything you paid for it. If a price is wrong, we may offer you the choice to go ahead at the correct price or cancel for a full refund.
We may limit quantities per order and may decline orders that appear to come from resellers.
6. Delivery
We ship to Australian addresses only, using Australia Post. Delivery times, shipping charges, and what happens if a parcel is lost, damaged or returned to us are set out in our Shipping Policy. Delivery times are estimates, and you are entitled to delivery within a reasonable time.
Ownership and risk of the goods pass to you when they are delivered to the address you gave us.
7. Returns, refunds and your consumer guarantees
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure.
Our Refund Policy explains how to make a claim and how change of mind returns work. Nothing in these terms or in our policies limits your rights under the Australian Consumer Law.
If you buy goods that are not ordinarily acquired for personal, domestic or household use, then to the extent the law allows, our liability for a failure to meet a consumer guarantee is limited, at our choice, to replacing or repairing the goods or paying the cost of replacing or repairing them.
8. Promotions
Offers such as free shipping or discount codes apply only for the dates and on the conditions stated. If you place an order during the offer period, you get the offer. Discount codes have no cash value, and unless we say otherwise, only one code can be used per order. Free shipping is not refunded on change of mind returns (see our Refund Policy).
9. Our intellectual property
All content on this website, including designs, artwork, logos, photographs, text and the Addo Outdoor name, is owned by or licensed to us and is protected by copyright and other laws.
You may view the website and buy our products for your own personal use. You must not copy, reproduce, modify, sell or use our designs or content for any other purpose, including printing them on other products, without our written permission.
10. Reviews and content you send us
You can post reviews through our review provider, Judge.me, or send us messages and photos. When you do, you confirm that you own the content or have permission to use it, and that it is honest, lawful, and does not defame anyone or infringe anyone's rights.
You give us a free, non-exclusive licence to display your review, your name and any photos you include on our website and in our marketing, for as long as we show the review.
We may remove content that breaks these terms. We do not remove reviews only because they are critical.
If you send us ideas or feedback, we may use them without payment or credit to you.
11. Third-party links and tools
Our website may link to other websites and uses third-party tools, such as our payment, review and shipping providers. We do not control them, and they have their own terms and privacy practices. To the extent the law allows, we are not responsible for third-party websites or services. We remain responsible for our own goods and for the consumer guarantees that apply to them.
12. Privacy
Our Privacy Policy explains how we handle your personal information. You can read it at addostore.com/policies/privacy-policy.
13. Our liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded.
Subject to that, and to the extent the law allows:
- we do not guarantee that the website will always be available, uninterrupted or error free, and we may take it offline for maintenance
- we are not liable for indirect or consequential loss, such as lost profit, arising from your use of the website or your inability to use it
14. Suspension and cancellation
We may refuse service, cancel an order before dispatch, or restrict your access to the website if you break these terms, if we reasonably suspect fraud or unlawful use, or if the law requires it. If we cancel a paid order before dispatch, we will refund you in full.
If you misuse the website or break these terms and that causes us loss, you are responsible for that loss to the extent the law allows.
You can stop using the website at any time.
15. Changes to these terms
We may update these terms from time to time. The terms in place when you place an order apply to that order, and we will not change the terms of an order we have already accepted. Updated terms apply to your later orders and your use of the website after the update date. The latest version is always at addostore.com/policies/terms-of-service, with the date it was last updated.
16. Governing law
These terms are governed by the laws of Queensland, Australia. You and we submit to the non-exclusive jurisdiction of the courts of Queensland and any Commonwealth court sitting in Queensland. This does not limit any right you have under the Australian Consumer Law to bring a claim elsewhere.
17. General
If part of these terms is found to be invalid or unenforceable, the rest still applies. If we do not enforce a right straight away, we have not given it up. You may not transfer your rights under these terms to anyone else without our written consent.
These terms and the policies they link to are the whole agreement between you and us about your use of the website and your purchases. This does not exclude statements we make about our products, which you can rely on under the Australian Consumer Law.
18. Complaints
If you have a complaint, email sales@addostore.com and include your order number if you have one. We will acknowledge it within 5 business days and aim to resolve it within 30 days. If you are not satisfied, you can contact the Queensland Office of Fair Trading or the Australian Competition and Consumer Commission (ACCC).
Privacy complaints are covered in our Privacy Policy.
